LEGAL NOTICE & TERMS OF DIGITAL GOODS TRANSACTION

(Governed under the Information Technology Act, 2000 & the Indian Contract Act, 1872)

TO WHOMSOEVER IT MAY CONCERN / PUBLIC NOTICE TO ALL BUYERS

This document constitutes a binding Legal Notice and Public Declaration of terms governing the delivery, consumption, and purchase of digital books (hereinafter referred to as the "Ebook" or "Digital Product") hosted on the Shopify ecommerce platform, operating and selling to consumers within the territory of India.

TAKE NOTICE that all transactions, agreements, and digital deliveries initiated through this platform are strictly governed by the statutory provisions of the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020. Any user who accesses, purchases, or downloads the Ebook is bound by the following legal terms:

  1. NATURE OF PRODUCT AND INSTANT DELIVERY: The Ebook is a non-tangible, digital asset. In accordance with Section 10A of the Information Technology Act, 2000, the contract of sale is deemed complete and legally binding immediately upon the successful authorization of payment at the checkout. Delivery is executed instantaneously via a displayed download link and an automated, system-generated electronic mail containing a permanent link.

  2. RECOGNITION OF COMPLETED PERFORMANCE: Under Indian law, delivery is considered legally executed and perfected the moment the digital download link is transmitted or generated for the buyer. Physical courier delivery, physical tracking IDs, or physical paper documents do not apply to this transaction.

  3. EXCLUSION OF RIGHT TO CANCEL / NO-REFUND STATUTE: In accordance with standard commercial practices for digital content, and under the premise that digital assets cannot be "returned" or "deprived of utility" once downloaded, the purchaser explicitly waives their right to cancel the transaction or claim a refund once delivery has been initiated. All sales are final.

  4. INTELLECTUAL PROPERTY PROTECTIONS: The Ebook delivered is protected under the Indian Copyright Act, 1957. The purchase of the Ebook constitutes the grant of a non-exclusive, non-transferable, personal-use license only. Any unauthorized reproduction, distribution, sharing, public display, or resale of this digital material constitutes a civil and criminal offense under Section 63 of the Copyright Act, 1957, liable for prosecution.

  5. LIMITATION OF LIABILITY AND TECHNICAL ISSUES: The platform owner is not liable for issues arising from third-party email providers, spam filters, incorrect email addresses provided by the buyer, or device incompatibility. In cases of delivery failure, the buyer is directed to seek manual rectification within 24 hours via the designated support email.

  6. JURISDICTION AND DISPUTE RESOLUTION: This agreement and any disputes arising out of the delivery or purchase of the Ebook shall be governed by and construed in accordance with the laws of India, subject to the exclusive jurisdiction of the courts where the business owner resides.

By proceeding with the purchase of the digital ebook, the buyer acknowledges that they have read, understood, and agreed to be bound by the terms of this Legal Notice, treating it as an electronic record under Section 2(t) of the Information Technology Act, 2000.
